Terms of Service

1. Acceptance of Terms

By creating an account or using CradleHQ (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a binding agreement between you and CradleHQ. We may update these Terms from time to time — see Section 8 for details on how we handle changes.

2. Description of Service

CradleHQ is a personal baby tracking application that allows parents and guardians to:

• Track feeding, sleep, and diaper activity
• Log milestones, first times, and growth measurements
• Write and store journal entries with photos
• Manage health records, vaccinations, and appointments

CradleHQ is intended for personal, non-commercial use by parents and guardians to document and manage their baby's first years. The Service is not intended for use by children.

CradleHQ is designed for and directed to users located in the United States, Canada, and Mexico. By using the Service, you represent that you are located in one of these countries.

3. User Accounts

To use CradleHQ, you must create an account with a valid email address and password. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately if you suspect unauthorized access to your account

By registering, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. Acceptable Use

You agree to use CradleHQ only for its intended purpose and in compliance with all applicable laws. You must not:

• Use the Service to store or share illegal, harmful, or offensive content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Scrape, crawl, or systematically download data from the Service
• Use the Service for any commercial purpose without our express written permission
• Reverse engineer, decompile, or attempt to extract our source code
• Interfere with or disrupt the integrity or performance of the Service
• Create multiple accounts to circumvent restrictions or abuse free tier limits

We reserve the right to suspend or terminate accounts that violate these rules.

5. Content You Upload

You retain full ownership of all content you create or upload to CradleHQ, including journal entries, photos, and tracking data ("Your Content").

By uploading content, you grant CradleHQ a limited, non-exclusive license to store, display, and process Your Content solely for the purpose of providing the Service to you. We do not claim ownership of Your Content and will not use it for any other purpose.

You are responsible for ensuring that you have the right to upload any content you provide, and that it does not infringe on the rights of others.

6. Disclaimer of Warranties

CradleHQ is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

• The Service will be uninterrupted, error-free, or fully secure
• Any data stored in the Service will be preserved indefinitely
• The Service will meet your specific requirements

CradleHQ is a tool to help you track and document your baby's development. It is not a medical device and is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider with questions about your baby's health.

7. Limitation of Liability

To the fullest extent permitted by law, CradleHQ and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to loss of data or loss of profits.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim (or $0 if you have not paid us anything).

8. Changes to Terms

We may update these Terms as CradleHQ grows and evolves. When we make material changes, we will notify you by email or through a prominent notice in the app at least 14 days before the changes take effect.

Your continued use of CradleHQ after the effective date of updated Terms constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Service and may delete your account.

9. Termination

You may stop using CradleHQ and request deletion of your account at any time by emailing us at privacy@cradlehq.app. We will process your request and remove your personal data and baby profile within 30 days, in accordance with our Privacy Policy.

We reserve the right to suspend or terminate your account if you violate these Terms, with or without notice depending on the severity of the violation.
